Terms of Clearance:
Package was improperly submitted as a regular package, instead of a submission as an emergency as per the previous terms of clearance from 5/16/02, when package was returned as improperly submitted. Package is therefore cleared for 6 months (as would be the case if it was correctly submitted as an emergency) in order to allow the Department time to submit a full clearance. At the time that the full clearance package is submitted, ED should have a fully electronic process for the application and Phase 1 data. If the form is not able to be fully electronic, ED will explain why, and work to make electronic processes available ASAP. Burden numbers have decreased significantly because of a miscalculation of burden at the time of the last submission. ED shall work to ensure that burden calculations are correct to the best of their knowledge prior to OMB submission. This collection was modified without OMB approval based on changes to the program in the 1998 HEA Amendments. This modification was a violation of the PRA, and should be reported as such in the next ICB. In addition, this collection was allowed to expire because ED said that the application was not needed after expiration. However, the application package was used after the expiration date; while the package was sent out prior to expiration, responses from grantees were required after the package was allowed to expire. This was an additional violation of the PRA and should be reported as such in the ICB for next year.

Abstract:
The information is required of institutions of higher education designated as Historically Black Colleges and Universities and Historically Black Graduate Institutions funded under Title III, Part B of the Higher Education Act of 1965, as amended. This information will be used for the evaluation process to determine whether proposed activities are consistent with the legislation and to determine dollar share of congressional appropriation.
