Abstract:
In this MO&O and 2nd R&O, ET Docket No. 98-206, FCC 02-116, Multiple Video Distribution and Data Service (MVDDS) licensees are required to meet the statutory definition of Multiple Video Programming Distributors (MVPD) to comply with the broadcast carriage requirements under 47 U.S.C. Section 325(b)(1). Any MVDDS licensee that is an MVPD must obtain a broadcast station's prior express authority before retransmitting the station's signal, subject to the exceptions under Section 325(b)(2) of the Communications Act of 1934, as amended.
