Abstract:
On June 15, 2006, President Bush established the Northwestern Hawaiian Islands Marine National Monument (Monument) by issuing Presidential Proclamation 8031 (71 FR 36443, June 26, 2006) under the authority of the Antiquities Act (Act) (16 U.S.C. 431). The Proclamation includes restrictions and prohibitions regarding activities in the Monument consistent with the authority provided by the Act. Specifically, the Proclamation prohibits access to the Monument except when passing through the Monument without interruption or as allowed under a permit issued by NOAA and FWS. Vessels passing through the Monument without interruption are required to notify NOAA and FWS upon entering into and leaving the Monument. Individuals wishing to access the Monument to conduct certain regulated activities must first apply for and be granted a permit issued by NOAA and FWS and certify compliance with certain vessel monitoring system requirements. On or about August 28, 2006, NOAA and FWS intend to publish a rule codifying the provisions of the Proclamation.
Emergency Justfication:
The National Oceanic and Atmospheric Administration requests an emergency review of an information collection request for the provisions contained in a rule to codify Presidential Proclamation 8031, which designated the Northwestern Hawaiian Islands Marine National Monument (the Monument) on June 15, 2006. Proclamation 8031 contained several provisions requiring NOAA and the Department of the Interiors Fish and Wildlife service (the agencies) to collect information from certain individuals and entities proposing to operate in the Monument. Specifically, individuals and entities must apply for a permit to enter the Monument and conduct regulated activities and must provide notification to the agencies when passing through the Monument without interruption. In addition, vessels entering the monument must install and operate a vessel monitoring system (VMS), and certify compliance with the VMS installation checklist, by August 28, 2006. Because of the VMS and other requirements of Proclamation 8031, the agencies need to immediately begin collecting information from these individuals and entities.
