This ICR is approved on the understanding that the revised online version of the application form will mirror the revised paper-based application form and that the eased liability requirements are still sufficient to protect claimants. SSA should resubmit this ICR if comments to the interim final rule associated with this ICR requires this ICR to be revised. At that time, this ICR should be submitted as "associated with rulemaking."

Abstract:
Section 303 of the Social Security Protection Act of 2004 (SSPA) provides for a 5-year demonstration project to be conducted by SSA under which the direct payment of SSA approved fees is extended to certain non-attorney claimant representatives. To be eligible for direct payment of fees, a non-attorney representative must fulfill 5 key statutory requirements. Through a private contractor SSA will collect required information to determine eligibility for direct payment of representation services.

Short Statement:
Based on experience gained during the application process, the existing collection instrument must be revised to add additional questions that the applicant must answer in order to be eligible for participation in the demonstration project. In addition, SSA is adding the Continuing Education (CE) collection to this ICR. The CE collection was inadvertently missed in the original clearance of the Demo project and SSA obtained approved under a separate OMB control number, 0960-0737 to bring it into PRA compliance.
