Abstract:
Hazardous materials are identified to ensure safe and appropriate handling, and to facilitate emergency response during transportation. The security regulations require offerors and carriers to develop and implement security plans, and to train their employees to recognize and respond to possible security threats. Under the current NPRM, HM-232E, we are proposing to revise the current requirements in the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) applicable to the safe and secure transportation of hazardous materials transported in commerce by rail. Specifically, we are proposing to require rail carriers to compile annual data on specified shipments of hazardous materials, use the data to analyze safety and security risks along rail transportation routes where those materials are transported, assess alternative routing options, and make routing decisions based on those assessments. We are also proposing clarifications of the current security plan requirements to address en route storage, delays in transit, delivery notification, and additional security inspection requirements for hazardous materials shipments. A security plan will enable shippers and carriers to reduce the possibility that a hazardous materials shipment will be used as a weapon of opportunity by a terrorist or criminal.

Under ICTS, the former IC system, this IC displayed both the number of respondents and the number of responses as 54,860. The correct number of respondents is 42,000; the correct number of responses is 54,860. These numbers have been adjusted accordingly in this current IC. In addition, because of the proposed revisions in HM-232E, the number of respondents will be increased by 139 persons, for a revised total number of 42,139 respondents. The number of responses will also increase by 139, for a revised total number of responses of 54,999. The burden hours are currently 376,250. Because of the proposed revisions in HM-232E, this number will increase by 51,469 for the first year, for a revised total of 427,719 burden hours. Finally, the burden costs of this IC was not accounted for under the ICTS system. The burden costs are currently $16,931,250. Because of the proposed revisions in HM-232E, this number will increase by $3,130,859.27, for a revised total of $20,062,109.27 burden costs.
