The information collection provisions associated with the Migrant Education Program NPRM are not approved at this time. ED only has approval to use the forms that are not being changed. ED has not been granted approval to use forms that are being revised through this information collection request. ED will submit an emergency extension request to ensure that approval for the underlying requirements does not expire before July 31. ED will review public comment in response to this NPRM and determine whether any change needs to be made to this collection and resubmit in conjuntion with the final rule.

Abstract:
Section 200.83 and 200.84 of the regulations for Title I, Part C establish the minimum requirements an SEA must meet for development of a comprehensive needs assessment and plan for service delivery as required under Section 1306(b) of the Elementary and Secondary Education Act (ESEA), as amended (P.L. 107-110). ?200.88 of the regulations clarify a statutory exclusion from determining compliance with the "comparability" and "supplement, not supplant" provisions of the statute. 200.89 establishes the authority of the Secretary to: allocate FY 2006 and subsequent year MEP funds using base year allocation amounts adjusted by State-reported defect rates; require retrospective and prospective re-interviewing processes; require the use of a standard certificate of eligibility; and require minimum quality control procedures relative to eligibility determinations.

The changes are to reflect the additional burden associated wtih the collection of information of the new proposed 2000.89, the reduction to 49 SEAs participating in the program for 200.83, 200,84 and 200.88; an increase in the wage rate of federal personnel: and adjustment of the federal costs to more clearly reflect annualized costs.
