Abstract:
Section 214 of the FACT Act (Pub.L. 108-159) requires financial institutions to disclose to consumers the opportunity to opt out of marketing solicitations from affiliates. The disclosures and responsive consumer opt-out notices comprise the elements of this collection of information.

Short Statement:
When this collection was first created in 2004, the Agencies sponsoring it (including FDIC) assumed that all supervised institutions (5,236 in the case of the FDIC) would be affected, and estimated burden accordingly. After three years of experience the agencies (including FDIC) have re-estimated the burden associated with this collection using the more accurate assumption that only institutions with affiliates will be affected. This has resulted in a significant downward adjustment in the estimated burden associated with this collection.

On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
