Short Statement: The Commission proposed a new rule, 12d1-4, which would provide exemptions to permit acquiring funds to invest in ETFs in excess of the limits of section 12(d)(1), subject to conditions that are designed to address the historical abuses that result from pyramiding and the threat of large-scale redemptions and that may arise in connection with investments in ETFs.
