Abstract:
The goal of section 258 is to eliminate the practice of "slamming", which is the unauthorized change of a subscriber's preferred carrier. The Commission released on January 09, 2008, In the Matter of Implementation of the Subscriber Carrier Selection Changes Provisions of the Telecommunications Act of 1996, Policies and Rules Concerning Unauthorized Changes of ConsumersÂ’ Long Distance Carriers, Fourth Report and Order, CC Docket No. 94-129, FCC 07-223. The Commission revises its requirements concerning verification of a consumerÂ’s intent to switch carriers. These new requirements will: ensure that each verification includes the date; expand the disclosure obligations of third party verifiers when consumers have questions during the verification; and otherwise clarify the required disclosures by verifiers to ensure that consumers better comprehend precisely what service changes they are approving. The Commission believes that these new requirements & additions will increase consumer confidence, clarify existing rules, and decrease the likelihood of slamming.
