Abstract:
The Endangered Species Act (ESA) prohibits the taking of endangered species. Section 10 of the ESA allows for certain exceptions to the prohibitions, such as taking that is incidental to an otherwise lawful activity. The corresponding regulations provide application and reporting requirements for such exceptions. The required information is used to evaluate the proposed activity (application) and ongoing activities (reports) and is necessary for NMFS to ensure the conservation of the species under the ESA.

Short Statement:
Based on information from the past three years, the estimated number of permit applications received per year has changed from 11 to 4, and the number of annual reports has changed from 11 to 9. This has reduced the estimated annualized hours from 1,048 to 472, an adjustment of 576 hours. Related costs have decreased from $660 to $450, an adjustment of $210 (note: in ROCIS the difference appears to be $550, due to the system's having rounded the previous cost up to $1,000). One possible reason for the decrease is that there was a one year spike in applications received in 2001 that would have boosted the earlier estimate.
