Abstract:
10 CFR 32 establishes requirements for specific licenses for the introduction of byproduct material into products or materials and transfer of the products or materials to general licensees or persons exempt from licensing, medical use product distributors to specific licensees, and those requesting a certificate of registration for a sealed source and/or device. It also prescribes requirements governing holders of the specific licenses. Some of the requirements are for information which must be submitted in an applicaiton for a certificate of registration for a sealed source and/or device, records which must be kept, reports which must be submitted, and information which must be forwarded to general licensees and persons exempt from licensing. As mentioned, 10 CFR 32 also prescribes requirements for the issuance of certiificates of registration (concerning radiation safety information about a product) to manufacturers or initial tranferors of sealed sources and devices. Submission or retention of the information is mandatory for persons subject to the 10 CFR 32 requirements. The information is used by the NRC to make licensing and other regulatory determinations concerning the use of radioactive byproduct material in products and devices.

Short Statement:
Though some increases in burden hours were noted, overall a decrease in estimated burden hours outweighed the increases as illustrated below: a. The burden estimate has been corrected downward by eliminating double counting of respondents under certain similar categories. b. Exempt distribution license review has been eliminated since the application review costs are already reported under OMB Clearance No. 3150-0120 for NRC Form 313. c. The total number of recordkeepers has decreased from 975 to 616 to more accurately reflect current data in the License Tracking System and Agreement State data which resulted in a decrease of total burden hours. d. There is a reduction in the number of respondents for Section 32.210 by 164 respondents from 600 to 224; the number of responses by 752 from 1,200 to 448 responses; and the burden by 15,792 hours from 25,200 to 9,408 hours. This reduction is based on the current number of actions worked on rather than the total number of registrants, thereby making the overall burden reduction for this section, an estimated 12,684 hours, an agency adjustment. The overall burden for this clearance has decreased by an estimated 12,684 hours from the currently approved burden of 179,188 hours to the proposed burden of 166,504 hours. The ROCIS Edit IC Worksheet for 3150-0001 (10 CFR Part 32), currently submitted to OMB for approval, shows a Program Change Due to Agency Discretion of 42,997 hours because of an error which occurred when data was entered into OMBs ROCIS electronic data system for an 83-C correction worksheet for this package which was submitted to OMB for review on 5/14/2008, and which was approved by OMB on 11/9/2008. When the current (2009) Part 32 ROCIS package was opened for processing, it contained two separate ICs split into beginning balances of 136,191 and 42,997 hours. To clarify this within the package, upon the advice of an OMB contractor, the 42,997 hour IC was removed, and its balance was added to the remaining IC within the package as a Program Change Due to Agency Discretion.
