Terms of Clearance:
Burden reductions contemplate change in type of response (to self-certification) and consolidating existing collected information into an electronic form. It is suggested that the agency be sensitive to efficiency gains from this revision as well as to potential burden hour increases and information duplication when contemplating an upcoming notice of proposed rulemaking that may affect this information collection.

Abstract:
To encourage small power and cogeneration production, the Public Utility Regulatory Policies Act of 1978 (PURPA) confers benefits on small power and cogeneration facilities that meet certain ownership and technical criteria. The Commission uses the FERC-556 (Cogeneration and Small Power Production, OMB Control Number 1902-0075) to implement the statutory provisions in Federal Power Act (FPA) section 3 (16 USC 792-828c) and sections 201 and 210 of the Public Utility Regulatory Policies Act (PURPA) of 1978 (16 USC 2601). These statutes authorize the Commission to encourage cogeneration and small power production and to prescribe such rules as necessary in order to carry out these statutory directives. Commission regulations pertaining to FERC-556 can be found in 18 CFR 131.80 and 18 CFR Part 292.

Short Statement:
The reporting requirements and regulations are not being changed at this time. This submittal replaces ICR#200905-1902-003. The difference is the preferred FERC-556 format [available under the IC record] that is expected to simplify the filing of the information and to improve the quality and usefulness of the data received. This format was not included in FERC's 60-day and 30-day notices, but in collaboration with OMB, we think that attaching it to this resubmittal will give the public an opportunity to review and comment on the preferred format. We are proposing the preferred format, but at this time FERC is not making additional changes to the estimated burden or cost per filing as the result of the new format.
