Abstract:
In a recent legal action, American Council of the Blind, et al v. Michael Astrue and Social Security Administration (No. C 05-04696 WHA (N.D. Cal.), the district court ordered SSA to offer two additional modalities(besides the three already available) for sending notices and other communications to blind or visually impaired applicants, beneficiaries, recipients, and representative payees. If members of these groups want to request another communication method besides the five ordered by the court, the will complete new form SSA-9000, the Request for Accommodation in Communication Method. The SSA-9000 will ask respondents to describe the type of accommodation they want, to disclose the condition they have that necessitates the need for a different type of accommodation, and to explain why none of the five methods already offered by the agency is sufficient.
Emergency Justfication:
In accordance with the district courts order (American Council of the Blind, et al v. Michael Astrue and Social Security Administration (No. C 05-04696 WHA (N.D. Cal.)), SSA must begin processing 45 C.F.R. 85.51 accommodation requests on April 15, 2010. Therefore, SSA is requesting emergency clearance under 5 CFR 1320.13. See Emergency Clearance Letter for further explanation in Supplementary Documents.

Short Statement:
This collection instrument will allow SSA to better serve the needs of the blind or visually impaired public. Under 45 CFR 85.51, SSA must take appropriate steps to ensure effective communication with applicants, participants, personnel of other Federal entities, and members of the public. Further, the regulation states that SSA must furnish appropriate auxiliary aids where necessary to afford an individual with handicaps an equal opportunity to participate in, and enjoy the benefits of, program or activity conducted by the agency. 45 CFR 85.51 (a)(1). The Court Order compels SSA to begin processing 45 CFR 85.51 accommodation requests on April 15, 2010 for blind or visually impaired Social Security recipients.
