This rulemaking is required by statute; the Omnibus Appropriations Act, as clarified by the Credit CARD Act, does not specify any particular types of provisions that the Commission should or should not include in a rule addressing loan modification and foreclosure rescue services but rather directs the Commission to issue rules that relate to unfairness or deception. The proposed disclosure provisions are designed to combat deception while the proposed recordkeeping provisions are needed to ensure effective and efficient enforcement of the proposed Rule and to identify injured consumers. The summary of burden pertains to these proposed information collection requirements.
