Abstract:
New Broadband Radio Service (BRS) and Educational Broadband Service (EBS) band plan transitions in Basic Trading Areas (BTAs), which will provide both incumbent licensees and potential new entrants in the 2495-2690 MHz band with greatly enhanced flexibility to encourage the efficient and effective use of spectrum domestically and internationally and the growth and rapid development of innovative and efficient communications technologies and services. This information collection contains four reporting requirements: 1) the pre-transition data request; 2) the transition notice; 3) the Initiation Plan; and 4) the post-transition notification.

Short Statement:
The Commission adopted FCC 10-107, Third Report and Order, which requires that licensees issued a new BRS license on or after November 6, 2009, would have four years from the date of initial license grant to provide substantial service. A licensee must demonstrate that it provided service which is sound, favorable, and substantially above a level of mediocre service which might minimally warrant renewal. Therefore, the Commission is eliminating four information collection burdens under 47 CFR 27.1231 and 27.1235 because they relate to the transition of BRS and EBS licenssees to the new band plan, i.e., pre-transition data request, the transition notice, the initiation plan, and post-transition notification. This change resulted in -4,947 hourly burden decrease and a $36,001 cost increase. The increase in cost is due to 2/3 of respondents will use outside consultants to prepare substantial service filings.
