First -- SEC will identify and address, where legally permissiable, any duplication of information collection with DOL/MSHA that involve the disclosure of mining-related fatalities prior to the submission of this collection package at the final rule stage. SEC should also address this in the supporting statement in its next submission. Second -- OMB files this comment in accordance with 5 CFR 1320.11( c ). This OMB action is not an approval to conduct or sponsor an information collection under the Paperwork Reduction Act of1995. This action has no effect on any current approvals. If OMB has assigned this ICR a new OMB Control Number, the OMB Control Number will not appear in the active inventory. For future submissions of this information collection, reference the OMB Control Number provided. Pursuant to 5 CFR 1320.11(c), OMB files this comment on this information collection request (ICR). The proposals in Release No. 33-9164 would implement Section 1503 of the Dodd-Frank Act. The changes in burden of Form 8-K relate to proposed new disclosure requirements about mine safety matters. These disclosure requirements implement Section 1503 of the Dodd-Frank Act, which requires filing of a Form 8-K disclosing receipt of specified mine safety and health orders and notices. The change in burden for Form 8-K corresponds to the new disclosure requirements. We estimate the proposal will result in an annual time burden increase of 214 hours and an increase in the cost burden of $28,500 for services of outside professionals.
