Abstract:
Pursuant to Amendment to the Commodity Exchange act found in the Food, Conservation, and Emergency Act 2008, Pub. L. No 110-246, 122 Stat. 1651, 2189-2204 (2008), the Commission has proposed a comprehensive set of rules applicable to intermediaries and counterparties engaged in the off and sale of off-exchange forex contracts to retail customers. New requirements under the proposed Part 5 include reporting and record-keeping obligations by retail foreign exchange dealers who fail to maintain required capital, reporting to customers, risk assessment filings and recordkeeping requirements
