Abstract:
ONRR proposes new regulations in title 30 CFR to implement the provisions of the Energy Policy Act of 2005 (EPAct) governing the payment of advance royalty on coal resources produced from Federal leases. The EPAct provisions amend the Mineral Leasing Act of 1920. ONRR also proposes to add information collection requirements that are applicable to all solid minerals leases and also are necessary to implement the EPAct Federal coal advance royalty provisions. ONRR would use the collected information to ensure that royalties are reported timely and paid appropriately and are based on correct product valuation. ONRR, as well as other Federal Government, State, and Tribal entities, would use the collected information for audit purposes and for evaluation of the reasonableness of product valuation or of allowance claims submitted by lessees. Failure to collect such data would prevent the Secretary from accomplishing statutory and trust responsibilities.
