Abstract:
The proposed OGE Form 201-A, for use only for electronic requests via an agency Web site, will collect certain information from and provide certain information to, persons who seek electronic access to OGE Form 278 Public Financial Disclosure Reports, including OGE Form 278-T Periodic Transaction Reports, filed on or after January 1. 2012. The proposed OGE Form 201-A would collect the requester's name, city, state, and country of residence, and require that the requester acknowledge his or her awareness of the legal uses of the information contained in public financial disclosure reports and civil penalties for persons who obtain or use a public financial disclosure report for a prohibited purpose. The proposed OGE Form 201-A will also alert requesters that intentional falsification of the information required by the form may result in prosecution under 18 U.S.C. section 1001. Requesters are mostly members of the public, particularly representatives of the news media, public interest groups and private citizens, with some Federal agencies and employees.
Emergency Justfication:
OGE has determined that its request for emergency clearance meets the standards of 5 C.F.R. section 1320.13(a) because the passage of the STOCK Act (as amended) required agencies to post most public financial disclosure reports no later than December 8, 2012, which is clearly shorter than the processing time frames called for under the PRA. This request for emergency clearance procedures is necessary to prevent a statutory deadline from being missed. OGE has followed guidelines for the emergency clearance procedures at section 1320.13 and has issued the required Federal Register notice pursuant to 5 C.F.R. section 1320.5(a)(1)(iv). OGE has taken all practicable steps to consult with agencies and the general public to minimize the burden of this proposed information collection. Since the STOCK Act was signed into law April 4, 2012, OGE has consulted with interested agencies across the executive branch on all aspects of implementing the Act. OGE has also met with members of several non-government organizations and other members of the public to inform them of the STOCK Act's provisions and OGE's plan to implement the Act. The new IC form would require that less information be provided and be less burdensome than agencies and the public are used to under the current process utilizing the OGE Form 201.
