Terms of Clearance:
This ICR is approved for 4 months while the agency develops a plan for the fingerprint cards to comply with Federal government's 1997 standards on collecting race and ethnicity information. The plan should outline a strategy for complying with the standards as expeditiously as possible, taking into account factors such as providing adequate lead time to card users. In addition, this collection has been in use without a valid OMB control number, which is a violation of the PRA. The agency should examine is PRA procedures and practices to ensure it meets the PRA's time deadlines. Also, the burden estimates in the supporting statement do not match the burden estimates in ROCIS, and information in response to SS q15 suggests the burden change estimates are attributed to new statutes whereas the ROCIS summary of burden table attributes the burden change to agency discretionary action. The agency should ensure that when it resubmits this collection the burden estimates are as accurate as possible, are consistent throughout the ICR package, and that burden change estimates are attributed to the correct categories.

Abstract:
These forms are the means by which federal, state, and local agencies, as well as individuals, submit fingerprint identification information. Title 28, United States Code, Section 534, allows the Federal Bureau of Investigation (FBI) to aquire, collect, classify, and preserve identification/information, criminal identification, crime, and other records. The FBI permits such exchange of records and information with, and for the official use of, authorized officials of the Federal Government, including the United States Sentencing Commission; the States and cities; and penal and other institutions.

Short Statement:
The increase of 1.4 million burden hours can be accredited to the increase of friction ridge submissions by respondents during the past 3 years, to include the submissions of palmprints. The increases can be attributed to new federal and state legislation requiring fingerprint based background checks for employment such as Section 6201 of the Affordable Care Act, as well as authorized agencies implementing requirements for the Adam Walsh Act, the Serve America Act, and Sexual Offender Registry requirements for palmprint submissions.
