Abstract:
The information request is related to PBGC's interim final rule prescribing the application process and notice requirements for partitions of eligible multiemployer plans under title IV of the Employee Retirement Income Security Act of 1974, as amended by the Multiemployer Pension Reform Act of 2014
Emergency Justfication:
Regulatory guidance is required to implement ERISA section 4233 as amended by Multiemployer Pension Reform Act of 2014 ("MPRA"). This guidance includes the procedure for the plan sponsor to submit an application for partition and to provide notice to participants and beneficiaries. Section 4233 is inextricably linked to the suspension of benefit rules under ERISA section 305(e)(9), which require the Department of Treasury, in consultation with PBGC and the Secretary of Labor, to publish appropriate guidance under section 201 not later than 180 days after the date of the enactment of MPRA (June 15, 2015). PBGC expects to publish an interim final rule in June 2015 that adds a new Part 4233 to PBGC’s regulations to provide guidance on the necessary information required by PBGC to process an application for partition of eligible multiemployer plans and comply with the statutory conditions required for a partition order. The rule needs to go into effect and the information collection needs to be approved upon publication. Accordingly, PBGC is requesting OMB’s approval on an emergency basis of the information requirements described in the interim final rule.
