The control number for this collection expired on 3/31/15 and the agency did not submit a new ICR until 8/27/15 which violates the procedures of the PRA. We recommend that the agency review its PRA procedures to ensure ICRs are submitted in accordance with the procedures of the PRA. In addition, the supporting statement was not been updated to reflect the current ICR (the collection is characterized as new, and the response to question 8 reflects a 2011 FR notice). If and when the agency submits a new ICR for this collection, it should update the supporting statement.

Abstract:
The Office of the Assistant General Counsel for Aviation Enforcement and Proceedings (Enforcement Office), including its Aviation Consumer Protection Division (ACPD), monitors compliance with and investigates violations of the Department of Transportation's (Department) aviation economic, consumer protection, and civil rights requirements. The ACPD's website has an on-line form by which a consumer can electronically submit a service-related complaint against (or comment about) an airline or other travel-related company that has an air component. The remaining complaints are received by letter, email, and in some cases by telephone. All complaints are reviewed to determine the extent to which carriers are in compliance with federal aviation consumer protection and civil rights requirements and to determine when enforcement action may be necessary.

Short Statement:
The Department's Enforcement Office has broad authority under 49 U.S.C., Subtitle VII, to investigate and enforce consumer protection and civil rights laws and regulations related to air transportation. Each disability-related complaint must be investigated as required by 49 U.S.C. ยง 41705. Among other things, the office is responsible for receiving and investigating service-related consumer complaints filed against air carriers. To expedite this process, the office's ACPD has provided the public with an on-line form, available through its website, by which a consumer can electronically file such a complaint against an air carrier using a computer or personal mobile device. Increase in use of the online form is the main reason for the increase in the number of people filing complaints or sending comments.
