Abstract: The information collected is used to ensure new or novel signal and train control technologies meet proposed performance standards and work as intended in the U.S. rail environment. FRA's rule primarily amends the regulations implementing a requirement of the Rail Safety Improvement Act of 2008 that certain passenger and freight railroads install positive train control (PTC) systems governing operations on certain main line tracks. This rule revises an existing regulatory exception to the requirement to install a PTC system for track segments carrying freight only that present a de minimis safety risk. The rule also adds a new exception for unequipped trains associated with certain yard operations to operate within PTC systems. The rule also revises the provisions related to various failures of a PTC system, adds new provisions related to other failures of a PTC system, and amends the regulations on applications for approval of certain modifications of signal and train control systems. Last, this final rule makes technical amendments to FRA's other signal and train control regulations and FRA's regulations governing highway-rail grade crossing warning systems.

Emergency Justfication: FRA is requesting Emergency processing approval seven (7) days after publication of the required Notice in the Federal Register on December 28, 2015, see 80 FR 80876, because FRA cannot reasonably comply with normal clearance procedures since they would be reasonably likely to disrupt the collection of information. Each railroad is required to submit its revised PTCIP to FRA by January 27, 2016. FRA cannot wait the typical 90-day period for public comment. Therefore, FRA is seeking OMB approval on or before January 4, 2016.

Short Statement: Total burden for this information collection submission has increased by 1,900 hours from the last approved submission. The change in burden is due to solely to proposed new Form FRA F 6180.164, PTCIP Template. Program change(s) shown in the table provided in the answer to question number 15 of the attached Supporting Justification increased the burden amount by 1,900 hours, and increased the number of responses by 38. The correct current inventory exhibits a burden total of 3,119,084 hours, while the present submission reflects a burden total of 3,120,984 hours. Hence, there is a total burden increase of 1,900 hours. There is no change in cost to respondents.
