Terms of Clearance:
OMB appreciates the continued collaboration between CJIS and BJS to learn more about the barriers for increasing law enforcement agency participation in NIBRS, and effective ways for addressing those barriers. OMB requests that upon resubmission of this collection for renewal that the agency provide OMB with an update on the progress made around recruitment. As per the previous terms of clearance, OMB requests that CJIS keep it apprised of progress at appropriate times, but no less than annually, during the 3 years in which this collection is approved under the PRA with the next update coming in June 2016. In addition, OMB requests that the agency pay close attention to and develop a process for dealing with issues that are identified by the National Academies panel and by LEAs regarding the user-friendliness of NIBRS for participants, particularly newly recruited participants, and the utility of the data for various policy and program stakeholders.

Under U.S. Code, Title 28, Section 534, Acquisition, Preservation, and Exchange of Identification Records; Appointment of Officials, June 11, 1930; Public Law 109-177 (H.R. 3199), March 9, 2006, USA Patriot Improvement and Reauthorization Act of 2005; PL 110-457, Title II, Section 237(a), (b), December 23, 2008, the William Wilberforce Trafficking Victims Reauthorization Act of 2008, and Matthew Shepard Hate Crimes Prevention Act, April 28, 2009, this collection requests Incident data from city, county, state, tribal and federal law enforcement agencies in order for the FBI UCR Program to serve as the national clearinghouse for the collection and dissemination of incident data and to publish these statistics in Crime in the United States, Hate Crime Statistics, and Law Enforcement Officers Killed and Assaulted.

There is no increase in burden on the individual respondents; however, the overall annual burden hours has increase. This is an adjustment, a increase from 72,456 to 77040 which is a increase of 4584. This increase in burden is due to the number of respondent agencies increase.
