Abstract:
Drivers applying for a commercial drivers license (CDL) must obtain training on certain topics. The applicant must present his employer/motor carrier with a certificate executed by a qualified trainer and indicating successful completion of such training. These requirements appear at 49 CFR 380.501 et seq. This submission is due to a NPRM titled, "Minimum Training Requirements for Entry-Level Commercial Motor Vehicle Operators," which responds to a Congressional mandate imposed under the Moving Ahead for Progress in the 21st Century Act. The proposed rule is based on consensus recommendations from the Agency's Entry-Level Training Advisory Committee, a negotiated rulemaking committee which held a series of meetings between February and May 2015. The compliance date of this proposed rule would be three years after the effective date of the final rule. The final ELDT rule was published on 12/8/2016. It is effective 02/6/2017 and the compliance date is 3 years after the effective date, 02/7/2020. The current entry-level training rules remain in effect for the entirety of the 3-year period therefore FMCSA does not wish to amend its current estimate of the information collection burden of FMCSA’s driver-training regulations, which was approved on 12/23/2015 until 12/31/2018. Therefore the burden for the next three years will be estimated as if there had been no change in the rules. FMCSA will provide revised burden estimates for the final rule at the end of the 3-year period.
