The next submission to OMB must include the draft final rule. Prior to the next submission of this Information Collection, CFTC will provide to OMB information related to its privacy policies including: 1) is the information collected in Form 102 maintained as part of a system of records; 2) does CFTC have a Privacy Impact Assessment or System of Records Notice that is applicable to the information collected in Form 102, if necessary; 3) whether the forms contained in this information collection request have been reviewed by CFTC’s privacy office or staff.

Abstract:
The reporting rules covered by OMB Control Number 3038-0009 are structured to ensure the Commission receives adequate information to carry out its market and financial surveillance programs. A separate rulemaking action regarding Position Limits for Derivatives proposes to relocate all reporting burdens under part 19 of the Commission’s regulations to a separate collection, OMB Control No. 3038-0013. This change is non-substantive but allows for all information collections related to exemptions from speculative position limits to be housed in one collection, making it simpler for market participants to know where to find the relevant PRA burdens. If adopted, OMB Collection No. 3038-0009 would hold collections of information related to parts 16, 17, and 21 while OMB Collection No. 3038-0013 would hold collections of information related to parts 19 and 150.

Burden is being reduced because part of 0009 burden related to two forms is being removed from 0009 and being consolidated into 0013. Specifically, form 204 ("Statement of cash positions in grains, soybeans, soybean oil, and soybean meal"), and form 304 ("Statement of cash positions in cotton"), are being removed from collection 3038-0009 and consolidated into collection 3038-0013.
