Abstract:
Section 713 of the Communications Act of 1934, as amended (the Act), 47 U.S.C. § 613, which was added pursuant to section 305 of the Telecommunications Act of 1996, requires the Commission to prescribe rules and implementation schedules for closed captioning of video programming. In enacting section 713, Congress generally required that video programming be closed captioned, regardless of distribution technology, to ensure access to persons who are deaf and hard of hearing. On February 19, 2016, the Commission adopted Closed Captioning of Video Programming; Telecommunications for the Deaf and Hard of Hearing, Inc. Petition for Rulemaking, Second Report and Order, 31 FCC Rcd 1469 (2016), published at 81 FR 57473, August 23, 2016 (Closed Captioning Quality Second Report and Order). The purpose of this submission is to revise currently approved collections for the closed captioning rules (found in 47 CFR § 79.1), add the collections adopted in the Closed Captioning Quality Second Report and Order, and update the estimates of existing burdens that were included in the November 2014 Paperwork Reduction Act (PRA) submission to the Office of Management and Budget (OMB).

Short Statement:
Due to the adoption of the Commission’s Closed Captioning Quality Second Report and Order, FCC 16-17, amending its rules to allocate the responsibilities of VPDs and video programmers with respect to the provision and quality of closed captioning and the completion of an earlier one-time collection requirement, the Commission reports the following program changes: the annual number of respondents has increased by +37,430, from 22,565 to 59,995 annual number of respondents; annual number of responses has decreased by -636,606, from 1,149,437 to 512,831 annual number of responses; the annual burden hours has decreased by -551,796, from 1,254,358 to 702,562 annual burden hours; and the total annual cost has decreased by -$4,581,900, from $40,220,496 to $35,638,596 annual cost.
