This emergency request is approved with the understanding that the changes to the terms and conditions of the promissory note applies to the no greater than $31 million loan note to USVI’s WAPA for its urgent funding needs. The agency will come back to OIRA for any further loans with terms and conditions that differ from the standard promissory note under this program.

Abstract:
The Loan Package for the Community Disaster Loan Program provides States, Local and Tribal governments that have suffered substantial loss of tax or other revenues as a result of a major disaster or emergency, the opportunity to obtain financial assistance in order to perform their governmental functions. Local governments can submit a loan package for the Community Disaster Loan Program. This loan must be justified on the basis of need and actual expenses.
Emergency Justfication:
The Federal Emergency Management Agency (FEMA) seeks emergency approval for the revision of OMB Collection 1660-0083, Application for Community Disaster Loan (CDL) Program, for the U.S. Virgin Islands. It is vital this collection be revised and implemented by November 9, 2017. In accordance with the Paperwork Reduction Act (PRA) and the Office of Management and Budget’s (OMB) implementing regulations at 5 C.F.R. § 1320.13: (1) this information is essential to the mission of the agency, (2) this information is necessary prior to the expiration of time periods established under PRA, (3) public harm is reasonably likely to result if normal clearance procedures are followed, and (4) an unanticipated event has occurred.

Short Statement:
1. We have removed FF090-0-2 “Application for Community Disaster Loan” because it is no longer being utilized to capture this information. 2. Grant/loan laws requires gathering data on FF112-0-3C “Certifications Regarding Lobbying; Debarment, Suspension and Other Responsibility Matters; And Drug-Free Workplace Requirements” which used to belong to OMB Collection 1660-0025. That collection has transitioned to a database for collecting the information captured in said form and has requested eliminating this form from their collection. Our OMB Collection 1660-0083 requests adopting this form into our forms collection. 3. A “Grammatical change” was made to FEMA Form 116-0-1 replacing “State” with “Component Unit” in order to make the form universal for use with the United States Territories of the Virgin Islands and Puerto Rico. Additional term pages were added to the form to allow for additional terms of the loan to be outlined as needed for the territories receiving Disaster Loan assistance from FEMA and the US Treasury.
