Abstract:
Domestic law and international obligations require that NMFS collect information about the harvest of certain fishery products when these products are entered into U.S. commerce and/or exported from the United States. To this end, NMFS has implemented a number of trade monitoring programs to collect information from the seafood industry regarding the origin of certain fishery products. The purpose of these programs is to determine the admissibility of the products in accordance with the specific criteria of the trade measure or documentation requirements in effect for the species of fish that are being imported or exported. NMFS collects the required information electronically through the International Trade Data System (ITDS) maintained by U.S. Customs and Border Protection. The ITDS information collection is merged with the Seafood Import Monitoring Program, both previously approved by OMB.

This is a request to renew/extend a previously approved information collection. Based on actual submissions/responses from 2016 through 2019, the burden estimates have been adjusted. In addition, the burden is adjusted to account for the merger of collections 0648-0732 (ITDS) and 0648-0739 (SIMP). There are several factors which contribute to divergence in the burden estimates once -0732, -0739 and -0776 are merged. First, there is only one consolidated trade permit, so estimates of the number of respondents made for the individual collections would lead to double counting if summed across programs. The current estimate of annual trade permit applications/renewals is 1800 respondents. Second, the original approval for -0739 used an alternative to the NMFS calculation by applying a method submitted by a stakeholder group. Since this was a new program, OMB directed NMFS to use the stakeholder method as an "upper bound" burden estimate that became the approved burden level. Given experience gained with the several import monitoring programs, NMFS has standardized the burden calculation method and used recent figures on actual numbers of respondents/responses. These figures are reflected in the estimates presented under Item 12. Finally, the original submissions for -0739 and -0776 included the "audit" response as part of the recordkeeping requirement. Now that NMFS has experience with the auditing process, the information allows separation of this aspect of the burden. This is more accurate because not all entries for which records must be maintained are actually selected for audit.
