Abstract:
The Bald and Golden Eagle Protection Act (Eagle Act; 16 U.S.C. 668-668d) prohibits take of bald eagles and golden eagles except pursuant to Federal regulations. The Eagle Act regulations at title 50, part 22 of the Code of Federal Regulations (CFR) define the “take” of an eagle to include the following broad range of actions: To “pursue, shoot, shoot at, poison, wound, kill, capture, trap, collect, destroy, molest, or disturb.” The Eagle Act allows the Secretary of the Interior to authorize certain otherwise prohibited activities through regulations.

Short Statement:
Early revision to seek OMB approval of ICs associated with Interior's "ePermits" initiative. Additionally, OMB approved all information collection requirements associated with the migratory birds and eagles under OMB Control No. 1018-0022, “Federal Fish and Wildlife Permit Applications and Reports—Migratory Birds; 50 CFR 10, 13, 20, 21.” We request approval to reinstate OMB Control No. 1018-0167, “Eagle Take Permits and Fees, 50 CFR 22” in order to transfer all requirements associated with eagles back into that collection. Separation of eagle requirements from migratory bird requirements will reduce confusion and burden on the public. We will submit this reinstatement request concurrently with the revision to 1018-0022.
