Abstract:
This request is for revision and extension of this information collection. Changes were made to the financial disclosure form in response to Fishery Management Council suggestions, in order to increase clarity for respondents. NOAA Fisheries is making minor revisions to the form by adding clearer instructions and clarifying some of the questions asked to ensure the questions are consistent with the regulatory requirements. Revisions will also include a specific check box to indicate that a Council nominee, and not a member, is completing the form. No new information is being requested. Section 302(j) of the Magnuson-Stevens Fishery Conservation and Management Act (MSA) requires that Council members appointed by the Secretary, Scientific and Statistical Committee members appointed by a Council, or individuals nominated by the Governor of a State for possible appointment as a Council member disclose their financial interest in any Council fishery. These interests include harvesting, processing, lobbying, advocacy or any marketing activity that is being, or will be undertaken within any fishery over which the Council concerned has jurisdiction. The purpose of filing this statement is to assist the member in avoiding conflicts of interest between official duties and private financial interests or affiliations. Council nominees must file this form with the NOAA Fisheries Assistant Administrator by April 15th or, if nominated outside of the annual appointment process, 1 month after nomination by the governor. After appointment by the Secretary, a voting council member must file this form with their council’s executive director within 45 days of the start of their term (e.g., September 25th for terms beginning on August 11th). All council members must file this form with their council’s executive director by February 1st each year, regardless of whether any information on the form has changed. Additionally, all council members must file an update with their council’s executive director within 30 days of the time any financial interest is acquired or substantially changed.
