Terms of Clearance: OMB approves this emergency information collection request for a period of six months. Given ED's inability to seek public comment in advance due to the urgent nature of CARES Act implementation, ED requests a waiver from the requirement to publish notice in the Federal Register seeking public comment during the period of OMB review. ED will solicit public comment within a reasonable period, but not later than May 30, 2020.

Abstract: The Governor's Emergency Education Fund awards grants to Governors (states) for the purpose of providing local educational agencies (LEAs), institutions of higher education (IHEs), and other education related entities with emergency assistance as a result of the coronavirus pandemic. The Department will award these grants - to States (governor’s offices) based on a formula stipulated in the legislation. (1) 60% on the basis of the State’s relative population of individuals aged 5 through 24. (2) 40% on the basis of the State’s relative number of children counted under section 1124(c) of the Elementary and Secondary Education Act of 1965 (ESEA).

Emergency Justfication: Section 18002(a) of the CARES Act states that “the Secretary of Education shall issue a notice inviting applications not later than 30 days of enactment of this Act and shall approve or deny applications not later than 30 days after receipt” to enable State educational agencies to apply for funds made available by the CARES Act. ED is requesting an emergency clearance to provide emergency support to State Education Agencies and carry out the requirements of the CARES Act. If this emergency collection is not approved, the Department will be unable to meet the requirement that a notice inviting applications is issued on or prior to April 26, 2020 and that funds are awarded on or prior to May 26, 2020. These funds are particularly needed in States that have experienced the greatest economic and educational disruptions caused by 2019-nCoV in order to support their recovery and the resumption of educational services.

Short Statement: This is a new information collection that would solicit from State educational agencies applications for funding under section 18002(a) of the CARES Act, the Governor’s Emergency Education Relief Fund (GEER Fund). The Department must collect this information in order to meet the requirements of the CARES Act. The total new burden to the public is 56 burden hours for this collection.
