OMB notes that portions of this information collection were previously conducted out of compliance with the Paperwork Reduction Act and the requirements of 5 CFR 1320, and OMB thanks the agency for rectifying this noncompliance in this package. The agency shall examine public comment in response to the proposed rulemaking and will include in the supporting statement of the next ICR—which is to be submitted to OMB at the final rule stage—a description of how the agency has responded to any public comments on the ICR, including comments on maximizing the practical utility of the collection and minimizing the burden.

Abstract:
The Commission is proposing to amend its regulations (and Engineering Guidelines) governing the safety of hydropower projects licensed by the Commission under the Federal Power Act. These regulations are intended to promote the safe operation, effective maintenance, and efficient repair of licensed hydropower projects and project works to ensure the protection of life, health, and property in surrounding communities. Specifically, the Commission proposes to revise its regulations (and Engineering Guidelines) to: incorporate two tiers of project safety inspections by independent consultants, codify existing guidance requiring certain licensees to develop an owner’s dam safety program and a public safety plan, update existing regulations related to public safety incident reporting, and make various minor revisions.

The proposed IC activities in the proposed regulations and proposed Engineering Guidelines would be program changes at the discretion of the Commission. They would represent an increase in the total burden of IC activities pertaining to the safety of water power projects and project works. The program changes would include all of the estimated burdens of this IC request. Separately, the Commission’s staff expects to seek a control number for existing IC requirements not affected by the NOPR and proposed Engineering Guidelines.
