Abstract:
On December 27, 2020, SBA received reauthorization under the Economic Aid Act to resume guaranteeing PPP loans through March 31, 2021. This act amended the PPP to expand the categories of eligible loan applicants and eligible uses of loan proceeds, and also to streamline forgiveness for loans of $150,000 and under. In addition, the act created a new program under Section 7(a)(37) of the Small Business Act – the “Paycheck Protection Program Second Draw Loans” (Second Draw Program). The forms for which SBA seeks approval are for the Second Draw Program.
Emergency Justfication:
January 7, 2021 Susan Minson SBA Desk Officer Office of Management and Budget Dear Ms. Minson: Pursuant to the Office of Management and Budget (OMB) procedures in 5 CFR Part 1320, SBA requests emergency review of a new collection of information that is required to implement the Paycheck Protection Program Second Draw Loan Program (PPP Second Draw). This request for emergency processing, includes a request for waiver of the requirement to publish the 60-day and 30-day public comment notices in the Federal Register. The PPP Second Draw was recently authorized by the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (“Economic Aid Act”), Pub. L. 116-260, Div. N, Title III, Sec. 311 (December 27, 2020), to provide loans to borrowers that previously received an initial PPP loan under section 7(a)(36) of the Small Business Act and have used or will use the full amount of that PPP loan for authorized purposes on or before the expected date of disbursement of the PPP Second Draw loan. The program expires on March 31, 2021; therefore, there is an urgent need to have these application forms available for applicants to access the critically needed financial assistance under the PPP Second Draw Program without further delay. Without emergency processing, the program would expire before anyone could realize its benefits. Thank you for your consideration of this request.
