Abstract:
The final rule Operations of Small Unmanned Aircraft Systems Over People requires applicants who seek FAA acceptance of means of compliance and Declarations of Compliance to submit applications to report requested information. In addition, manufacturers who produce small UAS in accordance with the proposed standards are required to disclose information by labeling all small unmanned aircraft eligible to operate over people within two of the three categories the rule permits for such operations. Lastly, for two of the three categories of aircraft eligible to operate over people, manufacturers who obtain acceptance are required to make available remote pilot operating instructions that describe the small UAS and the declared category or categories of eligibility, describe permissible modifications that would not change the ability of the small UAS to meet the requirements for the applicable category or categories; and, if applicable, instruct operators on how to verify and change the mode or configuration of the small UAS. This ICR adds a maintenance-records retention requirement. That requirement was included in the final rule, but since it was not included in the NPRM, the public was not given an opportunity to comment.

On January 15, 2021, the FAA published a final rule, Operation of Small Unmanned Aircraft Systems Over People (2120-AK85). That final rule included a provision requiring retention of maintenance records in certain circumstances. However, the FAA neglected to provide opportunity for public comment in the NPRM for 2120-AK85. The FAA is requesting to add the maintenance-record-retention requirement of 14 CFR 107.140 in this ICR.
