Abstract:
To provide consumers with adequate information as to the identity of alcohol beverages and to prevent consumer deception and the use of misleading statements in the marketing of such products, the Federal Alcohol Administration Act at 27 U.S.C. 205(e) requires that alcohol beverages sold or introduced into interstate or foreign commerce be labeled in conformity with regulations issued by the Secretary of the Treasury. Under that authority, the TTB regulations require that, prior to an alcohol beverage product’s introduction into interstate or foreign commerce, the producer, bottler, or importer of the product apply for and receive TTB approval of the product’s label. For wines and distilled spirits, such respondents also may apply for exemption from label approval for products not sold or entered into interstate or foreign commerce. For distilled spirits, the TTB regulations also require approval of distinctive liquor bottles. Respondents use form TTB F 5100.31 or its electronic equivalent, COLAs Online, to request and obtain label approval, exemption from label approval, or approval of a distinctive liquor bottle. The form serves as both an application for and, if approved by TTB, a certificate of label approval (COLA), a certificate of exemption from label approval, or distinctive liquor bottle approval.

Short Statement:
Program Changes: As a matter of agency discretion, TTB is revising this information collection to provide for four new “allowable revisions” to previously approved alcohol beverage labels, and TTB is expanding two existing allowable revisions that it already describes on TTB F 5100.31 and COLAs Online. “Allowable revisions” are revisions that bottler and importers can make to a previously approved label without requiring the submission of a new COLA application. TTB describes these changes in TTB Industry Circular 2021–1, Expansion of Allowable Revisions to Approved Alcohol Beverage Labels, which TTB has posted on its website at https://www.ttb.gov/industry-circulars. Adjustments: The program changes described above will result in a small reduction in the number of COLA application submissions submitted to TTB. However, due to changes in agency estimates, TTB is increasing the overall estimated annual number of respondents, responses, and burden hours for this information collection. The estimated per-response burden remains the same, while the average number of responses per respondent decreases slightly. These adjustments from 2018 estimates to 2022 estimates are as follows: From 11,240 respondents to 12,500; from an average of 16.77 responses per respondent to 16.4; from 188,495 responses to 205,000; and 97,389 total burden hours to 105,917.
