Abstract:
The Federal Communications Commission (Commission) requests approval from the Office of Management and Budget (OMB) for a revision to a currently approved collection on FCC Form 175 under OMB Control Number 3060-0600, with no change in burden estimates. The currently approved collection requires a minor revision to include an additional certification on FCC Form 175 that requires an Auction 110 applicant to certify that it has read the public notice that describes procedures for the auction and that it has familiarized itself both with the auction procedures and with the requirements for obtaining a license and operating facilities in the 3.45-3.55 GHz band.
Emergency Justfication:
On June 16, 2021, the Office of Management and Budget (OMB) approved, on an emergency basis, a minor revision to OMB 3060-0600 to include an additional certification on FCC Form 175 for applicants seeking to participate in Auction 110. OMB’s emergency approval expires on December 31, 2021. FCC Form 175 is used by the public to apply to participate in auctions for Commission licenses and permits. The Commission’s rules require auction applicants to submit updates maintain the accuracy and completeness of to their FCC Form 175 applications until an auction closes, and an applicant must recertify its application whenever it submits any updates pursuant to this requirement. Parties interested in participating in Auction 110 were required to submit their FCC Form 175 applications no later than July 21, 2021. Auction 110 is scheduled to begin on October 5, 2021 and will be conducted using an ascending clock auction design with two phases: a clock phase consisting of successive clock bidding rounds in which bidders indicate their demands for a number of generic license blocks, and an assignment phase in which winning clock phase bidders will have the opportunity to bid for their preferred combinations of frequency-specific license assignments in a series of sealed-bid rounds. Once Auction 110 closes, Auction 110 applicants will no longer be required to maintain the accuracy and completeness of their FCC Form 175 applications. Because the duration of Auction 110 is dependent on bidders’ activity, the Commission does not know when the auction will close. Accordingly, the Commission requests that OMB extend its emergency approval for the additional certification on FCC Form 175 applicable to Auction 110 applicants for an additional six months, to ensure that it remains effect until Auction 110 closes.
