OMB approves this emergency information collection request (ICR) for a period of six months. In order to provide applicants adequate time to submit their applications and to ensure that awards are made prior to the end of the fiscal year, the Department has requested a six-month emergency approval of this ICR timed with the publication of the notices inviting applications and notice of final priority. The Department will publish a notice in the Federal Register providing for 30 days of public comment as part of their request for regular ICR approval.

Abstract:
On March 14, 2022, the Department published in the Federal Register a Notice of Proposed Priorities, Requirements, Definitions, and Selection Criteria for Expanding Opportunity Through Quality Charter Schools Program (CSP) Grants to State Entities (SE Grants), Grants to Charter Management Organizations for the Replication and Expansion of High-Quality Charter Schools (CMO Grants), and Grants to Charter School Developers for the Opening of New Charter Schools and for the Replication and Expansion of High-Quality Charter Schools (Developer Grants) (Vol. 87, No. 49, pages 14197-14210) (CSP NPP). Specifically, the Department proposed new priorities, application requirements, assurances, definitions, and selection criteria to create results-driven policies to help promote positive student outcomes, student and staff diversity, educator and community empowerment, promising practices, and accountability, including fiscal transparency and responsibility, in charter schools supported with CSP funds, which can serve as models for other charter schools. The priorities, requirements, definitions, and selection criteria in the CSP NPP are intended to supplement existing statutory and regulatory requirements governing CSP SE Grants, CMO Grants, and Developer Grants. The Charter School Programs Office of the Department requested emergency approval of a new information collection and is requesting continued approval for CSP SE Grants, CMO Grants, and Developer Grants generally; and for the CSP NPP, which requires the submission of a community impact analysis and information regarding contracts with for-profit management organizations. The CSP is authorized under Title IV, Part C of the Elementary and Secondary Education Act of 1965, as amended by the Every Student Succeeds Act (20 U.S.C. 7221-7221j). The CSP (Assistance Listing Numbers (ALN) 84.282, including SE Grants (84.282A), CMO Grants (84.282M), and Developer Grants (84.282B and 84.282E)) is a competitive discretionary grant program. The grant applications submitted for this program are evaluated based on how well an applicant addresses the selection criteria (and any competitive preference priorities) and are used to determine applicant eligibility and award amounts for projects selected for funding.
Emergency Justfication:
The CSP SE Grants and Developer Grants programs timeline is extremely short due to the Biden Administration’s direction to the Department to create regulations to promote positive student outcomes, student and staff diversity, educator and community empowerment, promising practices, and accountability. The Notice of Proposed Priorities comment window was extended because of stakeholder feedback, and there were 26,588 comments received. Based on the number of comments that the Department needs to respond to the analysis took longer than usual. For these reasons, we request emergency approval of the CSP SE Grant, CMO Grant, and Developer Grant applications so that SEs, CMOs, and developers can demonstrate their eligibility and need to implement the program as intended and receive funds to address the needs of their students, staff, schools, and communities.
