Short Statement:
Although we have removed burden associated with cigar and pipe tobacco warnings (set forth in 21 CFR 1143.3 and 1143.5), we characterize this submission as an extension because the removals were made as a result of a September 2020 court order vacating these requirements and not through any agency action. We discuss this more fully in our supporting statement and in our 60- and 30-day Federal Register notices.
