Abstract:
VA Form 29-8600 form is used by the Department of Veterans Affairs to request information in order to adjudicate TSGLI claims for benefits. The form is filled out by members or former members of the uniformed services who have suffered a traumatic injury while in service, and the uniformed services approve or disapprove the claim. If the uniformed services approve the TSGLI claim, then the insurer for the TSGLI program, The Prudential Insurance Company of America (Prudential), pays the claim. The form is authorized by 38 USC 1980A and 38 CFR 9.20. VA Form 29-8600a form is used by the Department of Veterans Affairs to request information in order to adjudicate TSGLI appeals for benefits. The form is filled out by members or former members of the uniformed services who have suffered a traumatic injury while in service and had their TSGLI claim disapproved. The form is authorized by 38 USC 1980A and 38 CFR 9.20.
Emergency Justfication:
1. Public harm is reasonably likely to result if normal clearance procedures are followed – The TSGLI Form Control Numbers are required in order for VA OGC to clear and VA to subsequently publish a final regulation for the TSGLI program that provides additional benefits ranging from $25,000 to $100,000 to Service members and Veterans. Existing estimates indicate over a thousand prior TSGLI claimants may be entitled to additional benefits and a few hundred new claimants each year will be eligible for these funds. These funds cannot be issued, even to those that have documented proof of qualifying under the new rules, without the regulation/form publication. 2. The use of normal clearance procedures is reasonably likely to prevent or disrupt the collection of information or is reasonably likely to cause a statutory or court ordered deadline to be missed. The aforementioned regulation also contains VA’s response to a petition for rulemaking filed by a Service member and his attorney to change TSGLI regulations. This Service member has also filed suit in federal court in regard to this matter and the judge in a recent status report indicates that if the final regulation with response is not published by March 31, 2023, VA may be required to make an appearance before the district court judge to explain why it has taken VA so long to revise TSGLI regulations.
