Terms of Clearance:
In accordance with 44 USC 3507(j)(2) as amended and 5 CFR 1320.13, this information collection is approved as an emergency clearance in this specific circumstance to meet the requirements of the Bipartisan Infrastructure Law. If the Agency decides to continue use of the collection past the approved emergency clearance time period, it must resubmit an ICR to OMB under the normal PRA clearance process. The circumstances meriting this approval are permissible in this single instance. Should the agency attempt to submit future emergency requests under similar circumstances, i.e., due to falling behind on statutory or memo deadlines, the collection will be returned to the agency as improperly submitted and will require resubmittal as a conventional information request. OMB notes in this circumstance that DOE was approved to use this information collection beginning on March 6, 2023.

Abstract:
This Information Collection addresses a set of key cross-cutting metrics that will track across DOE programs to assess and communicate DOE’s progress toward meeting key agency priorities, including creating quality jobs, supporting domestic manufacturing, increasing equity and justice, reducing greenhouse gas (GHG) emissions, and providing pathways to private sector uptake.
Emergency Justfication:
DOE has determined that the information must be collected prior to the time periods established under Part 1320 of the regulation, and that this information is essential to DOE’s implementation of its programs included in the Office for Science and Innovation and the Office of Infrastructure; the Infrastructure Investment and Jobs Act (Public Law 117-58; commonly referred to as the Bipartisan Infrastructure Legislation, or BIL); Executive Order (E.O.) 14052, Implementation of the Infrastructure Investment and Jobs Act; and for the OMB requirements for grant and financial administration. As emphasized by OMB Memorandum M-22-12, implementation of BIL needs to be efficient and effective to deliver the best results, protect taxpayer dollars, and ensure public trust. Information gathered provides current information required to respond to the DOE Inspector General, OMB, congressional and consumer requests, and budget preparation. We submit an emergency request at this point due the exigent need to obtain more information about program execution under BIL. The size and pace of program execution create an urgent need for DOE to collect certain information in order to adequately monitor, report, and ensure transparency and accountability. Reporting that demonstrates compliance with statutory requirements and progress toward achieving outcomes is critical to maintaining accountability to taxpayers and advancing equity priorities. DOE is therefore requesting an Emergency Clearance for a six-month approval period to collect a set of key cross-cutting metrics that will track across DOE programs to assess and communicate DOE’s progress toward meeting key agency priorities, including creating quality jobs, supporting domestic manufacturing, increasing equity and justice, reducing greenhouse gas (GHG) emissions, and providing pathways to private sector uptake. During this approval period, DOE will work to establish a regular submission of this ICR.
