Abstract:
Section 118 of the Consolidated Appropriations Act, 2021 (CAA) (Public Law 116-260) enacted on December 27, 2020, amended Section 1860D-14 of the Social Security Act (the Act) (42 U.S.C. 1395w-114) and authorized CMS to make transitional coverage and retroactive Medicare Part D coverage for certain low-income beneficiaries, called the Limited Income Newly Eligible Transition (LI NET) program a permanent part of the Part D program. The LI NET program under this statute must begin no later than January 1, 2024.

Short Statement:
Our proposed rule (CMS-4201-P; RIN 0938-AU96) published on December 27, 2022 (87 FR 79452) to implement the following LI NET-related provisions. The rule proposes Transitional Coverage and Retroactive Medicare Part D Coverage for Certain Low-Income Beneficiaries Through the LI NET Program (§ 423.2500 Through § 423.2536). the rule would add 9,246 hr for beneficiaries, 1,223 hr for pharmacists, and 1,232 hours for LI NET sponsor. The rule would add a total of 11,701 hours. See section 12 of the attached Supporting Statement for details.
