In accordance with 5 CFR 1320, EPA is required to include the following information in its submission for information collection request review and approval: (1) supporting statements to show compliance with PRA requirements and other associated laws; (2) a description of the regulatory text applicable to the ICR including submission specifications; (3) a clear description of the data elements being collected under the ICR; (4) copies of the data collection instrument(s) and/or screen shots of the electronic portal where the reporting requirements are submitted to EPA (with the control number and burden statement included); (5) a detailed discussion of how information is submitted and the extent to which electronic reporting is available; (6) evidence of consultation with respondents (by actively reaching out to stakeholders as permitted by the PRA) to ensure the supporting statement's accuracy on availability of data, frequency of collection, clarity of instructions, accuracy of burden estimate, relevance of data elements, and similar PRA matters; and (7) discussion of how EPA addressed substantive concerns raised by respondents and other stakeholders during consultation and in response to comments received on FR notices. Abstract:
This ICR is for activities related to the implementation of the EPAs New Source Review (NSR) program, and renews the previous ICR. Title I, part C of the Clean Air Act (CAA or the Act)Prevention of Significant Deterioration, and part DPlan Requirements for Nonattainment Areas, require all states to adopt preconstruction review programs for new or modified stationary sources of air pollution. In addition, the provisions of section 110 of the Act include a requirement for states to have a preconstruction review program to manage the emissions from the construction and modification of any stationary source of air pollution to assure that the National Ambient Air Quality Standards are achieved and maintained. Tribes may choose to develop implementation plans to address these requirements. Implementing regulations for these three programs are promulgated at 40 CFR 49.101 through 49.105; 40 CFR 49.151 through 49.173; 40 CFR 51.160 through 51.166; 40 CFR part 51, Appendix S; and 40 CFR 52.21 and 52.24. In order to receive a construction permit for a new source or modification, the applicant must conduct the necessary research, perform the appropriate analyses and prepare the permit application with documentation to demonstrate that the project meets all applicable statutory and regulatory NSR requirements. Specific activities and requirements are listed and described in the Supporting Statement for the ICR. State, local, tribal or federal reviewing authorities review permit applications and provide for public review of proposed projects and issue permits based on their consideration of all technical factors and public input. The EPA, more broadly, reviews a fraction of the total applications and audits the state and local programs for their effectiveness. Consequently, information prepared and submitted by sources is essential for sources to receive permits, and for federal, state, and local environmental agencies to adequately review the permit applications and thereby properly administer and manage the NSR programs.
