Abstract:
This Information Collection is submitted to the Office of Management and Budget (OMB) to request revision of an existing Information Collection currently authorized under Information Collection 2120-0768, “Waivers and ATC Authorization in Controlled Airspace under Part 107.” The request will allow the Federal Aviation Administration (FAA) to leverage automated means of collecting and processing airspace authorizations and airspace waivers requested pursuant to 14 C.F.R. Part 107.

Short Statement:
Information Collection 2120-0768 was approved on April 16, 2020 for 41,883 hours. This approval was for airspace authorizations through LAANC and the web portal and airspace waivers and operational waivers through the web portal. This collection activity involves the operation of small Unmanned Aircraft Systems (sUAS), more commonly known as drones, which was a relatively new at the time of 2020 approval. Since the 2020 approval, operational waivers are no longer included in this Information Collection. Due to the complex and changing nature of operational waivers, they were placed into a new Information Collection, 2120-0027. Additionally, airspace waivers are currently estimated at a zero burden due to the FAA not currently accepting airspace waivers requests. This may change in the future, but due to the ease at which sUAS operators can request airspace authorizations under 14 CFR § 107.41 through either LAANC or the web portal and the decreased number of airspace waiver requests, the FAA has determined to suspend airspace waiver requests at this time (The FAA was receiving about 60 requests per month in the year leading up to suspension in March 2022). This may change in the future as UAS rules continue to evolve. The FAA will seek approval from OMB for a higher allocation if it is determined that airspace waiver requests will be accepted again. For airspace authorizations, the burden has increased from the 2020 approval. This is due to the continued increase use of airspace authorization requests. Airspace authorization requests remain a relatively new activity for the FAA and as new UAS regulations are put into effect, the way sUAS operators use the airspace changes, which impacts the burden estimates. The FAA now has more data on which to base its estimate and the data shows that the total number of burden hours on the public will increase for airspace authorizations due to increased number of requests. However, the burden on individual respondents to make airspace access requests has remained the same. There is also an increase in the cost of the federal government processing such requests. In the previous submission, it was thought that the number of federal personnel, whether contractors or federal employees, processing Part 107 requests through the web portal would decrease. That has not occurred, however. The demand has not only remained strong, but increased. The FAA estimates that the number of personnel processing Part 107 authorization requests will remain at the 2023 levels or slightly increase over the next three years.
