Abstract: The current submission is a request for a new clearance number, to be discontinued once the burden and associated information collections can be transferred into 3150-0011, the clearance for information collections contained in 10 CFR Part 50. PROPOSED RULE: 10 CFR Part 50, American Society of Mechanical Engineers Code Cases and Inservice Testing and Inservice Inspection Program Update Frequency -- This proposed rule is the latest in a series of rulemakings that incorporate by reference the latest versions of several RGs identifying new and revised unconditionally or conditionally acceptable ASME Code Cases that are approved for use. The NRC is proposing to amend its regulations to incorporate by reference proposed revisions of three regulatory guides, which would approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers. This proposed action would allow nuclear power plant licensees and applicants for construction permits, operating licenses, combined licenses, standard design certifications, standard design approvals, and manufacturing licenses to use the code cases listed in these draft regulatory guides as voluntary alternatives to engineering standards for the construction, inservice inspection, and inservice testing of nuclear power plant components. The NRC is requesting comments on this proposed rule and on the draft versions of the three regulatory guides proposed to be incorporated by reference. The NRC also is making available a related draft regulatory guide that lists code cases that the NRC has not approved for use. This draft regulatory guide will not be incorporated by reference into the NRC’s regulations. In addition, this rulemaking proposes to extend the time periods required for licensees to update their codes of record.

Short Statement: The proposed rule would increase the burden for 10 CFR Part 50 from 3,636,646 hours and 42,196 responses to 3,636,808 hours and 42,197 responses, a one- time per licensee increase of 162 hours and 1 response. The burden increases reflect the development and submission of 10 CFR 50.55a(z) alternative requests as required by NRC’s adoption condition Code Case N-716-3 and the accompanying recordkeeping requirements.
