Terms of Clearance:
This ICR request is approved for only one year due to failure to comply to prior terms of clearance. In accordance with 5 CFR 1320, EPA is required to include the following information in its submission for information collection request review and approval: (1) supporting statements to show compliance with PRA requirements and other associated laws; (2) a description of the regulatory text applicable to the ICR including submission specifications; (3) a clear description of the data elements being collected under the ICR; (4) copies of the data collection instrument(s) and/or screen shots of the electronic portal where the reporting requirements are submitted to EPA (with the control number and burden statement included); (5) a detailed discussion of how information is submitted and the extent to which electronic reporting is available; (6) evidence of consultation with respondents (by actively reaching out to stakeholders as permitted by the PRA) to ensure the supporting statement's accuracy on availability of data, frequency of collection, clarity of instructions, accuracy of burden estimate, relevance of data elements, and similar PRA matters; and (7) discussion of how EPA addressed substantive concerns raised by respondents and other stakeholders during consultation and in response to comments received on FR notices. Abstract:
The New Source Performance Standards (NSPS) for Incinerators (40 CFR Part 60, Subpart E) apply to existing incinerators that charge more than 45 metric tons per day (50 tons per day) of solid waste, and that commenced either construction or modification after August 17, 1971. Solid waste is defined as refuse, more than 50 percent of which is municipal type waste consisting of a mixture of paper, wood, yard wastes, food wastes, plastics, leather, rubber, and other combustibles, and noncombustible materials such as glass and rock. Owners and operators of existing incinerators that charge more than 45 metric tons per day (50 tons per day) of solid waste, and that commenced construction or modification after August 17, 1971 are required to comply with reporting and record keeping requirements for the General Provisions (40 CFR Part 60, Subpart A), as well as for the applicable standards in 40 CFR Part 60, Subpart E. This includes submitting initial notifications, performance tests and periodic reports and results, and maintaining records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. These reports are used by EPA to determine compliance with 40 CFR Part 60, Subpart E.

Short Statement:
The total decrease in burden from the most-recently approved ICR is due to adjustments. The adjustment decrease in burden from the most-recently approved ICR is due to a decrease in the number of sources. To identify the number of respondents subject to subpart E, we reviewed facilities identified in EPAs Enforcement and Compliance History Online (ECHO) database and the EPAs Large Municipal Waste Combustor and Small Municipal Waste Combustor Inventory (collected in 2019) to identify sources not subject to subpart E. The total number of respondents decreased from 87 in the previous ICR to 36 respondents. These changes reflect a more accurate estimate of the existing universe of incinerators subject to subpart E, which were last updated in 2007. In the previous ICR, estimates for Capital costs were in $2007 dollars, and the O&M costs were adjusted to $2018 dollars. For this ICR, the Capital and O&M costs were adjusted to $2021 dollars based on annual CEPCI values.
