Abstract:
This information collect is necessary to establish HUD's authority to file and investigate housing discrimination complaints under the Fair Housing Act of 1968, as amended. HUD uses this information to contact aggrieved persons, and to verify the required eleements of Fair Housing Act jurisdiction: Complainant's standing: covered Respondents: covered dwelling(s); covered transactions (subject matter); and timely filling (statute of limitations).
Emergency Justfication:
The emergency authorization is also necessary under 5 C.F.R § 1320.13(a)(2)(i) because public harm is reasonably likely to occur, and under 5 C.F.R § 1320.13(a)(1)(i) because FHEO’s ability to perform its mission will be hindered if it were required to comply with the 60-and 30- day notice requirements. During these 90 days, as well as the additional time it would take to conduct internal departmental clearance and await OMB approval, survivors of domestic violence will be without a proper method to submit information to FHEO to initiate investigations, and FHEO will be hindered in its ability to properly identify and assist these individuals. Emergency approval of the updated HUD 903 will allow FHEO to engage in the normal PRA process, including the 90-days of public comment, without harm to members of the public who need an immediate method of informing HUD that their rights have been violated under VAWA. This satisfies the requirement in 5 C.F.R § 1320.13(a)(1)(i) that the information collection is “needed prior to the expiration of time periods established under this Part” as well as the requirement in 5 C.F.R § 1320.13(a)(2)(i) that “Public harm is reasonably likely to result if normal clearance procedures are followed.”

Short Statement:
This is a request for Emergency Approval for additions to the text of a currently approved information collection. FHEO has revised the estimated total annual responses for this information collection based on data reported for FY 2022. FHEO is adjusting the estimated Annualized Reporting Cost Burden to persons submitting (“Reporting”) this Form to HUD by mail to reflect the current cost of First-Class Postage at Sixty-Three Cents ($0.63) per submission (“Report”), based on a one-time submission per aggrieved person. During FY 2022, HUD received approximately 1,213 submissions of potential complaint information by mail.
