Short Statement: The increase in burden is due to a higher estimate of the annual number of respondents and also increases in hourly wage rates over time. The estimated time necessary to complete each response remains unchanged. Additionally, Appeals identified a need to make some additional edits to p.2 of the EOIR-27. Some cases have multiple non-primary attorneys but no primary attorneys. In such circumstances, the BIA needs to advise the attorneys that the BIA may need to serve documents on a non-primary attorney. For this reason, we have updated the top box on p.2 of the form with a “Note” section.
