The agency is reminded that its forms should treat equally electronic and physical forms of signature and that any sound, sign, or process can qualify as a legally binding electronic signature (see the CIO Council's USE OF ELECTRONIC SIGNATURES published Jan 25, 2013). No later than one year after this approval, the agency will modify this form to ensure fully fillable signature field in sections 4 and 5. In doing so, the agency will allow for both digital signatures as well as typed signatures (unless the agency can demonstrate a fact-specific reasoning why, when the signing process is examined in full, a typed signature provides insufficient assurance of non-repudiation). Upon correcting the form, the agency will conduct a non-substantive change to upload the revised version. At this time the agency will also modify Question 3 of Supporting Statement A to indicate that the entire form can be completed, signed, and transmitted electronically.
