BOEM will transfer the hour burden and non-hour cost burden from this collection to OMB Control Number 1010-0176, which expires January 31, 2026, then discontinue the new number (OMB Control No. 1010-0195) associated with this rulemaking. Because the agency sought comments only on the changes associated with the regulation, the expiration date is the same as OMB Control Number 1010-0176.

Abstract:
The Bureau of Energy Management (BOEM), along with the Bureau of Safety and Environmental Enforcement (BSEE), are finalizing regulatory amendments related to approvals of meteorological buoys, geophysical and geotechnical survey submission requirements, renewable energy auction procedures, and funding of decommissioning accounts under the authority of the Outer Continental Shelf Lands Act (OCSLA). The proposed rule was published on January 30, 2023. This rule is also finalizing regulatory amendments previously proposed by BOEM that are now under the purview of the BSEE as a result of the Reorganization of Title 30 – Renewable Energy and Alternative Uses of Existing Facilities on the Outer Continental Shelf direct final rule (88 FR 6376, January 31, 2023), published by BOEM and BSEE, including amendments related to safety management systems, project verification procedures, and inspections.

Short Statement:
The new regulations revise requirements in 30 CFR 585. The rule decreases BOEM’s annual burden hours by 290 and number of responses by 2; the non-hour costs would remain unchanged. New § 585.413 aligns the regulations with the existing practice allowing lease and grant consolidation. BOEM adds 10 annual burden hours to the 2023 approval to account for submission of applications to consolidate part of (+10 annual burden hours) New § 585.600(a) revises the requirement for SAPs. Under the final rule, a SAP is required only when site assessment activities involved an engineered foundation. BOEM will not require a SAP for floating site assessment facilities, such as met buoys. BOEM also has the discretion to waive certain information requirements in a proposed plan, which could add flexibility to the permit application process. BOEM proposes to remove 240 annual burden hours from the 2023 approval. (-240 annual burden hours) Existing and new § 585.615(b) relates to other reports or notices that must be submitted periodically under an approved SAP. With the narrowing of the SAP requirement to site assessment activities only involving an engineered foundation, BOEM estimates fewer reports or notices will be filed under this section. BOEM is removing 60 annual burden hours from the 2023 approval. (-60 burden hours) For OMB Control Number 1010-0176, the existing annual burden hours are 9,876 and responses are 200. The final rule requirement changes, under temporary OMB Control Number 1010-0195, reduce the annual burden hours by 290 and responses by 2, making the total 9,586 annual burden hours and 198 respondents for 1010-0176.
